ARTICLE 1 — PURPOSE

These General Terms and Conditions of Sale govern any reservation made on the site. www.chezberanger-lemans.fr with GSLIBERTY for the short-term furnished rental of the accommodation “Chez Béranger”. Any reservation implies full and complete acceptance of these General Conditions of Sale.

ARTICLE 3 — HOUSING

Furnished tourist accommodation located in Le Mans (72000, Sarthe) — the precise address is communicated to the customer upon confirmation of reservation.

Exclusively tourist or leisure use, excluding any main residence or professional use. The customer cannot claim any right to remain in the premises or any rights under the law of 6 July 1989.

43.57 m² — 2 rooms — 1 bedroom — 4 people maximum

ARTICLE 4 — RESERVATION AND CONTRACT FORMATION

The reservation is made exclusively online on the Site. It is definitively constituted under the double condition of full payment by bank card via Stripe. and upon receipt of a confirmation email from GSLIBERTY.

A short-term furnished rental contract is then sent to the customer for electronic signature. This contract details the specific conditions of the stay and the internal regulations, which the customer acknowledges having read.

In the event of unsuccessful payment, the reservation is deemed not constituted and the slot vacated without compensation on any part.

ARTICLE 5 — ABSENCE OF RIGHT OF WITHDRAWAL

In accordance with article L. 221-28 12° of the Consumer Code, the customer does not benefit from any right of withdrawal for accommodation services provided on a specific date. The reservation is final upon confirmation.

ARTICLE 6 — PRICE AND PAYMENT

The total price shown when booking includes:

The rent of the stay
cleaning costs (flat rate)
the tourist tax (collected for the town of Le Mans, art. L. 2333-26 CGCT)

All prices are expressed in euros including all taxes (TTC).

Payment exclusively by credit card via Stripe. Payment in cash or by check is not accepted.

The cleaning fee covers the preparation of the accommodation prior to arrival. They do not exempt the customer from returning the accommodation in a generally acceptable condition (dishes made, waste removed).

ARTICLE 7 — SECURITY DEPOSIT

A security deposit of up to 500 € is pre-authorized on the customer's bank card within 24 hours prior to arrival. This deposit is not cashed unless damage is found. He is released within 7 days of departure subject to the absence of damage.

In the event of failure of the pre-authorization, GSLIVERTY reserves the right to refuse access to the accommodation without reimbursement.

ARTICLE 8 — CANCELLATION POLICY

Non-refundable policy. The total amount paid is definitively acquired by GSLIVERTY as soon as the reservation is confirmed, regardless of the cancellation date or the reason. In case of early departure or no-show, no refund is due.

The customer is invited to take out cancellation insurance at his own expense if he wishes.

Exception: in the event of total impossibility of providing the accommodation due exclusively to GSLIBERTY (accident, force majeure within the meaning of art. 1218 of the Civil Code), the customer is fully reimbursed, without any other compensation.

ARTICLE 9 — HOURS AND CONDITIONS OF OCCUPANCY

Arrival: Starting at 17:00
Departure: Before 11:00
Maximum capacity: 4 people

The detailed conditions of occupancy (animals, tobacco, noise pollution, subletting, etc.) are defined in the rental contract and the house rules provided upon confirmation of reservation.

ARTICLE 10 — INSURANCE AND LIABILITY

The accommodation is covered by non-occupying owner insurance (PNO). The customer is invited to check that their own liability insurance covers damage that may occur during the stay.

GSLIBERTY cannot be held responsible for interruptions in third party services (internet, energy), external disturbances, or the loss or theft of personal effects. Except for gross or fraudulent misconduct, GSLIVERTY's liability is limited to the amount of the stay concerned.

ARTICLE 11 — PERSONAL DATA AND COOKIES

The data collected during the reservation is processed by GSLIBERTY (data controller) on the basis of the execution of the contract (art. 6.1.b RGPD), for the purposes of managing the rental relationship. They are transmitted to technical subcontractors (Stripe, computer hosting) and kept according to the applicable legal periods.

The customer has a right of access, rectification, deletion and portability, as well as the right to file a complaint with the CNIL (www.cnil.fr) : contact@chezberanger-lemans.fr.

The Site uses cookies necessary for its operation. The customer is informed of their use during his first visit and can set his preferences.

ARTICLE 12 — MEDIATION AND DISPUTE RESOLUTION

In the event of a dispute, the customer is invited to contact GSLIBERTY first of all at contact@chezberanger-lemans.fr. In the absence of a satisfactory response within 60 days, the individual customer may use consumer mediation free of charge:

This system is free for the customer and does not exclude recourse to the courts.

In accordance with Regulation (EU) No. 524/2013, the European Commission provides a European platform for online dispute resolution: https://ec.europa.eu/consumers/odr

ARTICLE 13 — APPLICABLE LAW AND JURISDICTION

Applicable French law. In the event of a dispute:

Professional customer: Nantes Judicial Court (exclusive jurisdiction)
Individual customer (EU): Nantes judicial court or court of the place of residence (EU Regulation no. 1215/2012)
Customer outside the EU: Nantes Judicial Court (exclusive jurisdiction)

ARTICLE 14 — GENERAL PROVISIONS

GSLIBERTY reserves the right to modify these General Terms and Conditions of Sale at any time. The applicable version is the one in force on the date of the reservation.

If a clause is declared void or unenforceable, the other clauses remain in force.
